Welcome to TIDES. These Terms of Service ("Terms") govern your access to and use of the TIDES website, store, and all related products and services (collectively, the "Services"). The terms "we," "us," and "our" refer to TIDES. Our Services are powered by Shopify.

Please read these Terms carefully. By visiting, browsing, or purchasing through our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

Section 1 — Eligibility & Account

By using our Services, you confirm that you are at least the age of majority in your state of residence. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Accounts may not be transferred, sold, or assigned to another person.

You agree to provide accurate, complete, and current information when creating an account or placing an order. TIDES is not responsible for issues arising from inaccurate information you provide.

Section 2 — Products & Supplement Disclaimer

We make every effort to accurately represent our products, including images, descriptions, and ingredients. However, colors and appearance may vary depending on your device and display settings.

All TIDES products are dietary supplements intended for general wellness support. They are not intended to diagnose, treat, cure, or prevent any disease. Results may vary. Individual outcomes depend on a variety of factors including lifestyle, diet, and health status. We recommend consulting a qualified healthcare provider before beginning any new supplement regimen, particularly if you are pregnant, nursing, have a medical condition, or are taking prescription medications.

Product descriptions, formulations, and availability are subject to change at any time without notice. We reserve the right to discontinue any product or limit quantities at our discretion.

Section 3 — Orders

Placing an order constitutes an offer to purchase. TIDES reserves the right to accept, modify, or decline any order at its discretion. Your order is not confirmed until you receive an order confirmation email. Payment must be received and processed before an order is accepted.

Please review your order carefully before submitting. Cancellations may not be possible once an order has been accepted and processed. If we decline or cancel your order, we will notify you using the contact information provided at checkout.

All returns and exchanges are governed exclusively by our Refund Policy.

You represent that purchases are for personal or household use only and not for commercial resale or export.

Section 4 — Pricing & Payment

Prices are subject to change without notice. The price charged will be the price displayed at the time your order is placed, as confirmed in your order confirmation email. Displayed prices do not include applicable taxes or shipping unless expressly stated.

You represent and warrant that: (i) your payment information is accurate and complete; (ii) you are authorized to use the payment method provided; (iii) charges will be honored by your financial institution; and (iv) you will pay all amounts due, including taxes and shipping.

Promotional pricing is subject to separate terms and conditions. In the event of a conflict, promotion terms govern.

Section 5 — Shipping & Delivery

TIDES ships within the United States only. All delivery timeframes are estimates and are not guaranteed. We are not liable for delays caused by shipping carriers, weather, or other circumstances outside our control. Risk of loss and title for products pass to you upon transfer to the carrier.

Section 6 — Intellectual Property

All content on the Services — including text, images, graphics, logos, video, audio, product names, and design — is owned by or licensed to TIDES and is protected by U.S. copyright, trademark, and other intellectual property laws.

You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, publicly display, or create derivative works from any content without our prior written consent. All rights not expressly granted are reserved.

TIDES trademarks and trade dress may not be used without prior written permission.

Section 7 — Third-Party Tools & Links

The Services may include links to or integrations with third-party websites or tools. We do not control or endorse third-party content and are not responsible for any harm or damages arising from your use of or access to third-party services. Use of any third-party tools is at your own risk.

Section 8 — Relationship with Shopify

TIDES is powered by Shopify. All sales and purchases are made directly with TIDES. Shopify is not a party to any transaction between you and TIDES and is not responsible for any aspect of those transactions, including any injury, damage, or loss resulting from purchased products. You expressly release Shopify and its affiliates from all claims arising from your transactions with TIDES.

Section 9 — Privacy

Your use of the Services is subject to our Privacy Policy. By using the Services, you acknowledge that both TIDES and Shopify may collect and process personal information as described in our respective privacy policies.

Section 10 — User Feedback & Reviews

By submitting feedback, reviews, or other content to TIDES, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, and distribute that content for any purpose, including marketing and improving the Services.

You represent that you own or have the right to submit any content you provide, that it is accurate, and that it does not infringe the rights of any third party. TIDES reserves the right to remove any content we deem unlawful, offensive, or in violation of these Terms.

Section 11 — Errors & Inaccuracies

We reserve the right to correct typographical errors, pricing mistakes, or inaccuracies at any time without prior notice, including after an order has been submitted. We may cancel or adjust orders affected by such errors.

Section 12 — Prohibited Uses

You agree to use the Services only for lawful purposes. You may not:

Use the Services for any unlawful, harmful, or fraudulent purpose
Violate any applicable federal, state, or local laws or regulations
Infringe on the intellectual property rights of TIDES or any third party
Transmit viruses, malware, or any harmful code
Scrape, crawl, or collect data from the Services without authorization

We reserve the right to suspend or terminate access for any violation of these Terms.

Section 13 — Termination

TIDES may terminate or suspend your access to the Services at any time, without notice, for any reason including violation of these Terms. Upon termination, all provisions that by their nature should survive will remain in effect, including intellectual property rights, disclaimers, limitations of liability, and indemnification.

Section 14 — Disclaimer of Warranties

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Section 15 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TIDES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Section 16 — Indemnification

You agree to indemnify and hold harmless TIDES, Shopify, and their respective affiliates, officers, directors, employees, and agents from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of any law, or your use of the Services.

Section 17 — Governing Law

These Terms are governed by the laws of the State of Wyoming. You consent to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming for any disputes arising under these Terms.

Section 18 — General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. Our failure to enforce any provision does not constitute a waiver. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and TIDES. You may not assign your rights under these Terms without our written consent.

Section 19 — Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be communicated as required by applicable law. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
